Welcome to Anthems (“Anthems ”, “us”, “our”, and “we”), provider of the Anthems platform including: the application (App), website, Discord bot and services (referred to as ‘Platform’). These Terms of Use explains the how you may use the Platform (website, App, Discord bot and service). By downloading, accessing or using the Platform, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”) and to the collection and use of your information as set forth in the Anthems Privacy Policy. Anthems reserves the right to make unilateral modifications to these terms. This Agreement applies to all visitors, users, and others who download, access or use the ‘Platform’ (“Users”). PLEASE READ THIS AGREEMENT CAREFULLY, IF YOU DO NOT AGREE WITH ALL OF THESE TERMS IN ITS ENTIRETY, DO NOT ACCESS AND/OR USE THE PLATFORM. THESE TERMS OF USE (“TERMS”) SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS THAT GOVERN YOUR USE OF THE PLATFORM. BY ACCESSING OR THE PLATFORM, YOU ARE ACCEPTING THESE TERMS (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT), AND YOU REPRESENT AND WARRANT THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS, ARE OF LEGAL AGE TO FORM A BINDING CONTRACT, AND YOU HAVE THE AUTHORITY TO ENTER INTO THE TERMS (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT) WITH Anthems. THESE TERMS INCLUDE A CLASS ACTION WAIVER AND A WAIVER OF JURY TRIALS, REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, AND ALSO LIMIT THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.

Your account gives you access to the Platform and functionality that we may establish, maintain, redesign, restructure and modify from time to time and in our sole discretion. When connecting the Platform to third-party services, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

You may never use another User’s account without permission.

When creating your account, you must provide accurate and complete information and represent and warrant that you are at least thirteen (13) years of age. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. “Strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) are encouraged with your account. Anthems must be notified immediately of any breach of security or unauthorized use of your account. Anthems will not be liable for any losses caused by any unauthorized use of your account.

Creating an account with a false identity, information or for the purpose of impersonating, misleading, confusing, deceiving or misrepresenting yourself or others is prohibited.

Anthems reserves the right in its sole discretion to suspend or terminate your Account and/or refuse any and all current or future use of the Platform at any time for any reason.

We may require modification of your account name, content or information anytime at our discretion if they are offensive, infringe on any rights, can be confused with other users, are reserved by Anthems or to meet future requirements.

You agree that Anthems will not be liable to you or to any third party for any suspension or termination of your Account or any refusal of any use of the Platform.

You may create an account for free and enjoy access to certain features free of charge, however, certain premium features are subject to fees and payments, either one-time payment or subscription plans (“Paid Services”). Premium features are available via one-time payment or subscription plans (please review our pricing page in the Apple App Store or Google Play store for additional information).

We reserve the right, at our own discretion, to change any features or functionalities of the Paid Services. Changes to the Paid Services can be based on various factors, e.g., improving, managing the Services, complying with requirements or legal or technical requirements. Where such changes negatively affect an existing Paid Services in more than a limited way, you will be informed and may choose to terminate the Paid Services.

Paid Services in a form of subscriptions are auto-renewed, meaning payments will be auto-renewed following the end of the applicable period. You may cancel your subscription plan anytime through your Apple or Google account, as applicable to you. Should you choose to cancel your subscription, your access to the paid features will continue through the end of your billing period, as applicable, and expire thereafter, and you may be downgraded to the free Services. To the extent permitted by applicable law, any fees paid for your purchase of a subscription plan are non-refundable, and we do not provide refunds for any partial subscriptions.

We reserve the right to change the pricing of any Paid Services, in its sole discretion; however, once you have purchased a Paid Service, any such changes to your existing Paid Service will only apply following a thirty (30) day prior written notice.

Your payment will be charged through your applicable mobile store, such as Apple or Google and subject to the applicable terms and condition.

ELIGIBILITY: Open only to persons who are 18 years of age or older. Employees of Anthems Media are not eligible to enter or win a prize. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law.

CONTEST PERIOD: Weekly Leaderboard contests run from Sunday to Sunday in any given week - and will be decided at the end of the week.

HOW TO ENTER: In order to be eligible for the Anthems weekly tastemaker giveaway - you need to create an Anthems account and begin growing your tastemaker score by (1) signing artists, and/or (2) adding music to the community for upvoting.

WINNER SELECTION: The user with the highest tastemaker score at the end of the week will win the giveaway. (Max of 1 win per month per user) In the event that a potential winner is disqualified for any reason, Anthems may, in its sole discretion, award the applicable prize to an alternate winner selected.

CONDITIONS:Anthems reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest (or portion thereof). Anthems also reserves the right at its sole discretion to disqualify the Entry of any individual. All federal, state and local taxes on prize and any expenses not specified herein are the sole responsibility of winner. Should a dispute arise regarding the identity of the claimant, Anthems reserves the sole right to determine the eligible party.By entering, entrant waives all rights to bring (and covenants not to bring) any claim against Anthems or any otherS associated with this Contest. Entrants further agree to release and hold harmless Anthems from any and all liability arising from their participation in the Contest, or Anthems’ use of any entry information.Any disputes that may arise hereunder shall be governed in all respects by the laws of the state of California without regard to the conflicts of laws principles of any jurisdiction.

As part of our Services, you will need to log in to your Spotify account, following which we will be receiving information through the Spotify API. You hereby acknowledge and understand that by agreeing to these terms, you agree to be bound by the Spotify terms and conditions, policies and privacy notices.
